Anti-Agency Club - Privacy Policy
This Privacy Policy explains how TIDAL Digital FZCO ("Anti-Agency Club", "we", "us", "our") collects, uses, stores and protects your personal data when you visit anti-agency.club, join our waitlist, contact us, or use our diagnostic tool. We have written this in plain language wherever possible.
1. Who we are
Anti-Agency Club is a product owned and operated by TIDAL Digital FZCO, a company registered in Dubai Commercity, United Arab Emirates (Licence No. 50008). We are the controller of the personal data described in this policy - meaning we decide how and why it is used.
We operate globally and welcome users from any country. Because of this, more than one privacy law may apply to how we handle your data, depending on where you are based. Section 8 below sets out how this works in practice.
Contact for any privacy question or request: hello@anti-agency.club
2. What we collect
2.1 Information you give us
Waitlist sign-up: your name, company name, and work email address.
Contact form: your name, email address, and the content of your message.
Diagnostic results unlock: your first name, business name, and email address, if you choose to unlock your full action plan.
2.2 Information generated by using our diagnostic tool
Our diagnostic tool asks you a series of questions about your business and marketing activity, and calculates your result directly in your browser. If you view your result but do not go on to unlock the full action plan, we do not receive or store your answers at all - they stay on your device.
If you choose to unlock your full action plan, we anonymise and aggregate the underlying responses - combining them with data from other users so that no individual answer, business, or person can be identified - and use this aggregated data to improve the diagnostic and to benchmark results across users. We do not keep your individual questionnaire answers linked to you, and we never use this data to identify or contact you.
2.3 Technical and usage data
When you submit a form on our site, we automatically capture limited technical information alongside it, such as the page that referred you, your browser/device type, and any campaign tracking parameters (UTM tags) in the link you used. This helps us understand where enquiries come from.
2.4 Cookies
We do not currently run analytics or advertising cookies on this site. If and when we do, this will be governed by a separate Cookie Policy and you will be asked for your consent via a cookie banner before any non-essential cookie is set. See Section 9.
3. How and why we use your data
To respond to waitlist sign-ups and keep you informed ahead of launch (with your consent, and you can unsubscribe at any time).
To respond to enquiries made through our contact form.
To deliver your diagnostic result and, if requested, your full action plan.
To improve our diagnostic tool and benchmark results across users, using anonymised, aggregated data only.
To meet our legal, accounting, and regulatory obligations.
We do not sell your personal data to anyone, and we do not use it for purposes other than those set out above without telling you first.
4. Our legal basis for processing
Where UK or EU data protection law applies to you (see Section 8), we rely on the following legal bases:
Consent - for waitlist sign-ups and any marketing communications. You may withdraw consent at any time.
Legitimate interests - for responding to contact form enquiries and for improving our product through anonymised, aggregated benchmarking data, where we have concluded this does not override your rights and interests.
Contract / steps to enter a contract - for delivering the diagnostic result and action plan you have requested.
Legal obligation - where we must retain or disclose information to comply with the law.
5. How long we keep your data
We do not keep personal data for longer than necessary for the purpose it was collected for. Our current retention periods are:
Waitlist sign-ups: until launch plus 6 months, or until you convert to a customer or unsubscribe, whichever happens first - subject to an absolute maximum of 24 months from sign-up.
Contact form messages: approximately 24 months from your last contact with us.
Diagnostic contact details (name, business name, email, where provided to unlock a result): approximately 24 months from submission.
Diagnostic questionnaire answers: not retained on an individual basis. Only anonymised, aggregated trend data is kept, for as long as it remains useful for benchmarking; this data cannot be linked back to you.
After these periods, we securely delete or irreversibly anonymise your data. We are also building tools to let you request deletion or export of your data at any time - see Section 7.
6. Who we share your data with
We share personal data only with the following categories of third party, and only as needed to run our service:
Hosting provider: Render, which hosts our website and database.
Payment processor: Stripe, once paid subscription tiers are available (used only for billing, not for diagnostic or contact data).
Form/CRM processor: [FORM/CRM PROVIDER - TO BE CONFIRMED], used to process waitlist and contact form submissions.
Professional advisers and regulators, where required by law.
We do not share your data with third parties for their own marketing purposes.
7. Your rights
Depending on where you are based, you may have some or all of the following rights over your personal data: to access it, correct it, delete it, restrict or object to our use of it, receive a copy in a portable format, and withdraw consent at any time. You also have the right to complain to your local data protection authority.
To exercise any of these rights, contact us using the details in Section 1. We are putting in place a self-service tool to let you request deletion or export of your data directly; until it is available, we will handle requests manually. Where UK or EU law applies, we will respond within one month of receiving a valid request.
8. International use of this service
We are based in the United Arab Emirates and welcome users globally. Because we may be offering our service to, or monitoring the behaviour of, individuals in other countries, more than one privacy law can apply to the same processing activity:
8.1 United Kingdom and European Union
If you are based in the UK or EU, UK GDPR and/or EU GDPR apply to our processing of your data, and the rights described in Section 7 apply in full. [Where our EU user base grows to a level requiring it, we will appoint an EU representative under Article 27 GDPR and publish their details here.]
8.2 United States
If you are based in the United States, applicable state privacy laws (such as the CCPA/CPRA, where they apply to us) may give you additional or differently-framed rights, including the right to opt out of the "sale" or "sharing" of personal data. We do not sell or share your personal data with third parties for cross-context behavioural advertising.
8.3 United Arab Emirates
As a UAE free zone company, we are separately subject to UAE Federal Decree-Law No. 45 of 2021 (the Personal Data Protection Law) in our capacity as controller, regardless of where our users are based. We handle all personal data in line with these obligations.
8.4 Other jurisdictions
If you are based elsewhere, we aim to handle your data consistently with the standards set out in this policy, which are generally more protective than most other frameworks. Contact us if you have questions about how a specific local law applies.
9. Cookies
We do not currently use analytics or advertising cookies. Before we switch on any such tracking, we will publish a separate Cookie Policy and display a consent banner allowing you to accept or decline non-essential cookies before they are set. Essential cookies necessary to run the site do not require consent and are not covered by this section.
10. Children
Our service is intended for business owners and marketing professionals and is not directed at children. We do not knowingly collect personal data from anyone under 18.
11. Changes to this policy
We may update this policy as our product, processors, or legal obligations change. We will update the "last updated" date above and, where changes are material, take reasonable steps to bring them to your attention.
